EL RAPTO DE MADELEINE MCCANN: PERFIL CRIMINAL Y PSICOLÓGICO DEL DELINCUENTE
The following is my report based on the Criminal Profiling investigative procedure, also known as Offender Profiling or Psychological Profiling. It does not constitute proof, but an intent to help in the investigation.
El siguiente es mi informe basado en el procedimiento de investigación de Perfilación Criminal, también conocidao como Perfilación del Delincuente o Perfilación Psicológica. No debe tomarse como prueba, pero sí como un intento de ayudar en la investigación.
THE CRIME SCENE
The crime scene is the room of an apartment where Madeleine was sleeping in Praia da Luz, in the Portuguese Algarve. It is in the block 5, apartment A, the "5A". The toddler, of almost 4 years old, was in the room with her siblings, twins of 2 years old, who also slept. It is a ground floor, and the window had the shutters closed, the glass panes closed but not locked, and the curtains also closed.
LA ESCENA DEL CRIMEN
La escena del crimen es la habitación de un apartamento donde dormía Madeleine, en Praia da Luz, en el Algarve portugués. Es el bloque 5, apartamento A, el "5A". La niña, de casi 4 años, estaba en la habitación junto a sus hermanos mellizos de 2 años, que también dormían. Es una planta baja, y la ventana tenía las persianas bajadas, las hojas de vidrio cerradas pero no trabadas, y las cortinas también cerradas.
Sometime between 21:15 and 21:55, a woman saw in the middle of the street near the apartment, a man carrying a child in his arms. The child could be Madeleine. Just after 22:00 the members of an Irish family observed in the middle of the street, independently to the first witness, and in a place which is about 500 meters walk, a man carrying a child in his arms, also like Madeleine.
En algún momento entre las 21:15 y las 21:55, una mujer observó en el medio de la calle, cerca del apartamento, un hombre llevando una niña en brazos. La niña podría ser Madeleine. Apenas pasadas las 22:00 los integrantes de una familia irlandesa observaron en el medio de la calle, y en forma independiente a la primera testigo, y en un lugar que dista unos 500 metros a pie, un hombre llevando una niña en brazos, también parecida a Madeleine.
In both observations the individual was wearing a jacket and long pants, because the night was cool, but the girl was only wearing a pair of pajamas and she was barefoot. In pajamas and barefoot, so Madeleine was sleeping. Also in both incidents the man "did not seem to be a tourist".
En ambas observaciones el individuo lleva puesta una chaqueta y pantalones largos, debido a la noche que estaba fresca, sin embargo la niña sólo tenía puestos unos pijamas, e iba descalza. En pijamas y descalza, así estaba durmiendo Madeleine. También en ambos incidentes el sujeto "no parecía ser un turista".
Around 22:00 Madeleine's mother entered the room and found the shutters lifted, the right glass pane open, and the curtains on the same side moved. Madeleine was not in the room.
Alrededor de las 22:00 la madre de Madeleine entró a la habitación, y encontró las persianas subidas, la hoja de vidrio de la derecha abierta, y las cortinas del mismo lado movidas. Madeleine no estaba en la habitación.
THE MOTIVE
The primary motivation of the abductor is stealing values as money, mobile phones, laptops, watches, rings, etc. Small items of high value that can be easily transported without the need of a motor vehicle. But a sexual motive cannot be discarded yet.
EL MÓVIL
El móvil primario del secuestrador es hurtar valores como dinero, teléfonos móviles, ordenadores portátiles, relojes, anillos, etc. Pequeños objetos de alto valor que puede transportar fácilmente sin necesidad de disponer de un vehículo motorizado. Pero un motivo sexual no puede descartarse todavía.
The modus operandi is to open a window from the outside, in apartments that are occupied, but circumstantially, at the time of the facts, seems to be no one inside. Being surprised by the presence of Madeleine -she sees him, or he thinks so- decides to take her, for not to speak about the incident, and betray him. He is afraid to be caught and to end up in jail.
El modus operandi consiste en abrir una ventana desde el exterior, en apartamentos que están ocupados, pero que, circunstancialmente, en el momento de los hechos, parece no haber nadie en su interior. Al ser sorprendido por la presencia de Madeleine -la niña lo ve, o él cree que lo ve- decide llevársela, para que no hable del incidente y lo delate. Tiene miedo de que lo capturen y terminar en la cárcel.
He commits his crimes alone, or at most has an accomplice, fellow of wanderings, of total confidence.
Why do I say that it was a burglary that went wrong? Because of the great amount of such crimes that occurred in Praia da Luz. Only in blocks 4 and 5 apartments, there were 3 illegal window openings from outside, about 7, 17 and 75 days before the abduction of Madeleine. Of those 3 apartments, the one that is farther from 5A, is only 55 meters. In the 5L and 4A cases, the burglaries ended succesfully. In the case of 5G, the offender fled out through the window when he heard the owner of the apartment entering the room. The owner did not see his face.
El delincuente comete sus delitos en soledad, o como máximo tiene un cómplice, compañero de andanzas, de su total confianza.
¿Por qué afirmo que fue un hurto que salió mal? Por la gran cantidad de delitos de ese tipo que ocurrieron en Praia da Luz. Sólo en los bloques 4 y 5 de apartamentos, hubo 3 aperturas de ventana ilegales desde el exterior, aproximadamente 7, 17 y 75 días antes del secuestro de Madeleine. De esos 3 apartamentos, el que está más lejos del 5A, está a sólo 55 metros. En los casos del 5L y del 4A, los hurtos finalizaron con éxito. En el caso del 5G el delincuente huyó por la ventana cuando escuchó a la dueña del apartamento entrando en la habitación. La dueña no llegó a verle la cara.
When Madeleine's mother enters the room at 22:00, find the shutters lifted, the curtains moved and a glass pane of the window open. That is congruent with a very simple method of opening from outside, which I myself have been able to reproduce several times in a similar window: raise just a little the shutters, open the glass pane, move the curtain, and use the rope mechanism to lift and lock the shutters. If the glass pane does not have an automatic lock, or it does not function, as was in the case of the 5A window, it will be closed but not locked, and the entire process can be done without forcing, without causing damage.
La madre de Madeleine, cuando entra en la habitación a las 22:00, encuentra las persianas levantadas, la cortina movida y una hoja de vidrio de la ventana abierta. Esto es congruente con un método de apertura desde el exterior muy simple, que yo mismo he logrado reproducir varias veces en una ventana similar: levantar un poco la persiana, abrir la hoja de vidrio, mover la cortina, y utilizar la cuerda del mecanismo para terminar de subir la persiana y trabarla. Si la hoja de vidrio no tiene una traba automática, o si ésta no funciona, como fue en el caso de la ventana del 5A, quedará cerrada pero no trabada, y todo el proceso puede hacerse sin forzamientos, sin producir daños.
RELATION TO VICTIM
The abductor did not know the victim in advance, his motivation is another, to steal. If he has previously seen her, has been circumstantially. The victim is a toddler of nearly 4 years, thin, and according to her parents, and others who know her, she is a curious and intelligent girl. She could point out to the offender if she crossed him occasionally. Even she could recognize him by seeing him circumstantially before the kidnapping.
RELACIÓN CON LA VÍCTIMA
El secuestrador no conoce a la víctima con antelación, su objetivo es otro, hurtar. Si la ha visto previamente, ha sido circunstancialmente. La víctima es una niña de casi 4 años, delgada, y de acuerdo a sus padres, y a otras personas que la conocen, es una niña curiosa e inteligente. Podría señalar al delincuente si se lo cruzara en alguna ocasión. Incluso podría ser que lo reconociera por haberlo visto circunstancialmente antes del secuestro.
KNOWLEDGE TO COMMIT CRIMES
The offender knows how to open a window from the outside, and without damaging it if the conditions are right. No need to use any particular tool, only his hands. In Praia da Luz there are a lot of burglaries and he may have learned the art from other criminals. He does not think he need to be too much careful not to leave traces. He is not even very careful to ensure that no one is in the apartment he choose to target. He also has not been able to have an alternative plan in case something goes wrong during the burglary.
CONOCIMIENTOS PARA COMETER DELITOS
El delincuente sabe cómo abrir una ventana desde el exterior, incluso sin dañarla si se dan las condiciones. No necesita utilizar ninguna herramienta en particular, sólo sus manos. En Praia da Luz hay muchos hurtos y puede haber aprendido la técnica de otros delincuentes. No cree necesario cuidarse demasiado en dejar huellas. Incluso no es muy cuidadoso para verificar que no haya nadie en el apartamento que elige como objetivo. No ha sido capaz de tener un plan alternativo, por si algo sale mal durante el hurto.
Cases of burglary in Praia da Luz are not investigated in depth. Generally neither fingerprints are taken nor witnesses are wanted. It is preferred that the insurance take charge of the missing goods, and not that a bad image of the resort extends beyond. In the case of Madeleine, collecting forensic traces was hampered due to the large number of people who entered the primary crime scene just after. Moreover everything went very quickly, in a few minutes, and the abductor had no opportunity to leave much evidence. Although there is some evidence, and can be decisive in solving the case.
Los casos de hurtos en Praia da Luz no son investigados en profundidad. Generalmente no se toman huellas dactilares ni se buscan testigos en general. Se prefiere que el seguro se haga cargo de los bienes faltantes, y que no trascienda una mala imagen del complejo turístico. En el caso de Madeleine, la recogida de rastros forenses se vio entorpecida debido a la gran cantidad de gente que entró a la escena primaria del crimen, apenas acontecido. Por otra parte todo transcurrió muy rápidamente, en muy pocos minutos, y el secuestrador no tuvo posibilidad de dejar muchas evidencias. Aunque sí hay algunas evidencias, y pueden ser decisivas para resolver el caso.
KNOWLEDGE OF CRIME SCENE AND LOCATION
The fact that this man walks between 6 and 10 minutes with the child in arms through the streets, indicates that he has no motor vehicle, such as car or van, and live and/or work in the area ("did not seem to be a tourist"). When viewed at 22:00, he was walking towards a "Portuguese zone" of Praia da Luz. That zone is characterized by Portuguese residents of lower middle class, low and old houses, and very close to the sea.
CONOCIMIENTO DE LA ESCENA DEL CRIMEN Y DE LA LOCALIDAD
El hecho de que este hombre camina entre 6 y 10 minutos con la niña en brazos por las calles del lugar, indica que no dispone de vehículo automotor, como coche o camioneta, y que vive y/o trabaja en la zona ("no parecía ser un turista"). Cuando se lo ve a las 22:00, se dirige hacia una "parte portuguesa" de Praia da Luz, caracterizada por residentes portugueses de clase media-baja, y casas bajas y antiguas, muy cerca del mar.
The offender is integrated in that society and knows well the place. He belongs to a lower middle class, and their studies are at best secondary, and possibly unfinished. His works are commensurate with their level of education. When he does work, he does as a gardener, waiter, cook, etc. Or maybe as maintenance assistant in apartments, or in a hotel of the resort.
El delincuente está integrado en esa sociedad y conoce bien el lugar. Pertenece a una clase social media-baja, y sus estudios son como mucho secundarios, y posiblemente no terminados. Sus trabajos son acordes a su nivel de estudios. Cuando trabaja lo hace como jardinero, camarero, cocinero, etc. O quizás como ayudante de mantenimiento en los apartamentos, o en algún hotel del complejo turístico.
ABDUCTOR PERSONALITY
He is a man between 25 and 35 who live and/or work in Praia da Luz. He presents no psychotic disorder, does not suffer loss of reality. He knows what he is doing, in this case stealing. Within his limitations, he has been carried out the burglaries as planned.
PERSONALIDAD DEL SECUESTRADOR
Se trata de un hombre de entre 25 y 35 años, que vive y/o trabaja en Praia da Luz. No presenta ningún trastorno de tipo psicótico, no sufre pérdidas de la realidad. Sabe bien lo que está haciendo, en este caso hurtar. Dentro de sus limitaciones, lleva a cabo los hurtos según lo planificado.
He has an anti-social or psychopathic personality disorder. He can distinguish what is right from what is wrong, but is not worried, he lives by his own rules. It shows some superficial charm, and education in the daily face to face, and his neighbors consider him a good person. But in reality, he is not able to feel remorse or guilt, is not able to put him in the place of another, and is selfish. With a limited affect, he can simulate love, compassion or friendship, but actually he is only able to feel anger or sadness when things do not go according to his wishes. He is manipulative and often uses deception as a resource. His relationships are short-lived or nonexistent. He is irresponsible, and somewhat arrogant. Lives for the day, and has no realistic long-term plans. His academic intelligence, as we saw, is medium-low, and his emotional intelligence is very poor.
Posee un trastorno de personalidad anti-social o psicopática. Sabe distinguir lo que está bien de lo que está mal, pero no le preocupa, vive según sus propias reglas. Muestra cierto encanto superficial, y educación en el cara a cara diario, y sus vecinos lo consideran una buena persona. Pero en realidad, no es capaz de sentir remordimiento ni culpa, no se pone en el lugar del otro, y es egoísta. Con una afectividad limitada, puede simular amor, compasión o amistad, pero en realidad sólo es capaz de sentir ira o tristeza cuando las cosas no salen según sus deseos. Es manipulador y utiliza muchas veces el engaño como recurso. Sus relaciones de pareja son de corta duración, o inexistentes. Es irresponsable, y un tanto arrogante. Vive al día, y no tiene planes realistas a largo plazo. Su inteligencia académica, como vimos, es media-baja, y su inteligencia emocional es muy pobre.
PREVIOUS CONVICTIONS
If he has previous convictions, it will be for minor property crimes, not against people.
CONDENAS ANTERIORES
Si tiene condenas anteriores, serán por delitos menores contra la propiedad, no contra las personas.
ACTIONS AFTER THE ABDUCTION
The outcome is tragic. No sexual motives for the kidnapping, he only carried the girl to not endanger his own freedom. He considres his freedom of more value than Madeleine's life. He ends up committing murder, possibly suffocating her putting his hand over her face, and gets rid of the body not far from the place, possibly in the area from the Prainha to Mataporcas water treatment station. Throws her into the sea or into a dumpster, or hides her somewhere he knows. Perhaps to move her to somewhere far away, past some time.
ACCIONES QUE LLEVA A CABO LUEGO DEL SECUESTRO
El desenlace es trágico. No hay motivos sexuales en el secuestro, sólo se lleva a la niña para no poner en peligro su propia libertad. Para él tiene más valor su libertad que la vida de Madeleine. Termina cometiendo homicidio, posiblemente asfixiándola poniendo su mano sobre su cara, y se deshace del cuerpo no muy lejos del lugar, posiblemente en la zona que va desde la Prainha hasta la estación de tratamiento de aguas de Mataporcas. La arroja al mar, la tira dentro de un contenedor de basura, o la esconde en algún lugar por él conocido, quizás para trasladarla a algún sitio mucho más alejado, pasado cierto tiempo.
It is unlikely the offender confesses, given his psychopathic personality. He only will confess if caught and he can take some advantage of confession, as a reduced conviction. Few people suspect him in the town. If he has an accomplice, this person will be fully trusted, and will not speak for fear to be involved more than he is. The offender will not return to commit burglaries in Praia da Luz, because can not risk being surprised and linked to the crime of Madeleine.
Es difícil que el delincuente confiese, dada su personalidad psicopática. Sólo confesará si lo atrapan y puede sacar alguna ventaja de la confesión, como una reducción de condena. Poca gente sospechará de él en la localidad. Si tiene un cómplice, éste será de total confianza, y tampoco hablará por temor a que se lo involucre más de lo que está. El delincuente no volverá a cometer hurtos en Praia da Luz, no puede arriesgarse a que lo sorprendan y lo vinculen al crimen de Madeleine.
